(Hereinafter referred to as “MAISON MINELLI”)
MAISON MINELLI is a member of the Federation of Distance Selling Companies (FEVAD - 60, rue de la Boétie, 75008 PARIS) and has formally committed to respecting the principles of consumer protection contained in the professional charter.
It is specified that the Products are reserved for private individuals and intended for the Customer's personal use, unrelated to their professional use. In this respect, the Customer's attention is particularly drawn to the fact that the order may not be for more than 5 quantities of the same reference.
As part of its activity, the company MAISON MINELLI is registered with SYDEREP for Corporate Social Responsibility issues, under the following IDU numbers: FR390333_11HVZF for Products and FR390333_01FWTM for Packaging and Graphic Papers.
The company MAISON MINELLI also benefits from professional civil liability insurance taken out with the insurer AXA France IARD: 313, Terrasses de l'Arche, 92727 NANTERRE CEDEX
The purpose of these general terms and conditions of sale is to define the terms of distance selling between MAISON MINELLI and any non-commercial, adult natural person (hereinafter "the Customer") making a purchase on the Site, for the territory of mainland France.
MAISON MINELLI reserves the right to carry out any checks concerning the age of Customers and to cancel any order which does not meet the conditions set out in these general terms and conditions of sale, without this engaging the liability of MAISON MINELLI.
These general terms and conditions of sale are written in French. They specify in particular the various steps required for the Customer to place an order, the payment and delivery methods, and the tracking of the Customer's order.
Any order for Product(s) offered on the Site implies the Customer's acceptance of these general conditions of sale.
The Customer declares that they have read these general terms and conditions of sale before confirming the order. Confirming the order therefore constitutes acceptance without restriction or reservation of these general terms and conditions of sale and implies a declaration by the Customer that they have read and accepted them before making a purchase.
These general terms and conditions of sale constitute all contractual provisions concluded between MAISON MINELLI and the Customer, to the exclusion of any other clause or document exchanged between the parties, unless expressly agreed by MAISON MINELLI.
The photos of the Products on sale on the website www.minelli.fr have no contractual value.
In accordance with Articles L. 111-1 and L. 111-4 of the Consumer Code, the essential characteristics and prices of Products sold electronically are available on the Site.
MAISON MINELLI also communicates to the Customer information relating to its identity, postal, telephone and electronic contact details and its activities, as well as information relating to legal guarantees, the functionalities of the digital content and, where applicable, its interoperability, the existence and terms of implementation of the guarantees and other contractual conditions, in accordance with Articles R. 111-1 and R. 111-2 of the Consumer Code.
The Customer receives the information provided for in Articles L. 221-5 and L. 221-11 of the Consumer Code, prior to and after the conclusion of the sale and in particular by means of these General Conditions of Sale.
The Products offered for sale by MAISON MINELLI are those appearing on the Site on the day of consultation by the Customer and within the limits of available stocks.
The Products are presented by means of an information sheet including in particular the following information: Product name, size, color, description, composition, photo, price, if applicable, prepared with the maximum accuracy and precision in order to allow a description as faithful and complete as possible. However, given the digital presentation method of the Products on the Internet, it is possible that the Customer's perception of the photographic representation of the Products does not correspond exactly to the Product itself. MAISON MINELLI also reserves the right at any time to add new Products, to delete all or part of the Products presented for sale on the Site, or to modify their presentation, without any particular formalities vis-à-vis Internet users or Customers.
Information relating to the composition and/or usage instructions for the Products is available on the sheet for each Product. MAISON MINELLI undertakes to deliver Products that meet the current requirements relating to the safety and health of people in accordance with European provisions, and in particular the legislation on chemical substances with regulated content. The Customer is solely responsible for the choice of Products, their storage and their use.
The prices of the Products are those appearing on the Site on the day of consultation by the Customer and within the limit of available stocks. The prices of the Products are indicated in euros and are inclusive of VAT, excluding delivery costs.
Delivery costs are free to your home address in mainland France for all orders of €180 or more. A standard delivery fee of €5.90 applies to all orders under €180. The Products remain the property of MAISON MINELLI until full payment has been received by MAISON MINELLI.
Any order implies acceptance of the prices and description of the Products available for sale. MAISON MINELLI undertakes to honor orders received on the Site only within the limits of available stocks of the Products. If one or more Product(s) ordered are unavailable, MAISON MINELLI undertakes to inform the Customer by email within 5 working days. The Customer's order for an unavailable Product will then be automatically canceled.
MAISON MINELLI reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding the payment of a previous order or who presents any form of risk. Placing an order by the Customer implies their full and unreserved acceptance of these general terms and conditions of sale, to the exclusion of all other general terms and conditions of sale, including those in force in MINELLI stores.
The Customer places his order by completing the following seven steps:
Final acceptance of the order by the Customer is evidenced by the validation of their bank details (bank card number, expiry date and cryptogram).
This banking information is known only to the payment service provider selected by MAISON MINELLI. At the end of these steps, the Customer arrives on a page indicating that their order has been validated.
Within one hour of placing their order, the Customer will receive an email confirming:
The Customer's shopping cart is archived and kept for future orders for a period of 15 days, subject to availability, even in the event of an internet connection interruption. However, the items are not reserved for the Customer.
In order to access their archived shopping cart, the Customer must reconnect to the Site using the same computer with the same IP address for connecting to the service.
MAISON MINELLI may, in addition, contact any person with a customer account regarding the contents of an unvalidated shopping cart, by email and on the basis of the execution of pre-contractual measures, in a limited occurrence.
Order details are archived in accordance with Article L 213-1 of the French Consumer Code, for a period of ten years on a secure server. However, no credit card number is stored. The Customer accepts that the order confirmation is considered proof of the contractual relationship between the Parties.
Until the order is finalized by the Customer's payment validation, the Customer may make changes and update their shopping cart. They may thus modify a quantity; delete an item or simply continue shopping. To do this, simply click on the "Shopping Cart" section and make the desired changes. However, once the payment has been validated, the transaction is recorded and no recourse or online modification on the Site is possible. The Customer must comply with Article 7 below.
We offer our customers the option to pay for their purchases in 3 interest-free installments through our partner Scalapay.
Payment terms:
In case of difficulty:
For any questions or assistance regarding the 3-installment payment method, our customer service team is available to assist you. You can write to us at the following address: clients_minelli@maison-minelli.fr .
When validating your payment in 3 interest-free installments, it is normal that you are redirected to the Scalapay platform to provide payment information.
MAISON MINELLI reserves the right to cancel an order that presents, during verification of bank details by the payment service provider, a risk of fraudulent use of a bank card, or in the event of refusal of payment authorization by banking organizations. In addition, MAISON MINELLI reserves the right to refuse to honor an order from a consumer who has not fully or partially paid for a previous order or with whom a payment dispute is ongoing. All costs related to the aforementioned payment methods are the final responsibility of the Customer, it being specified that MAISON MINELLI is not responsible for any cost of any nature whatsoever, generated by the payment method selected by the Customer.
All purchases made on the Site are protected and secure 24 hours a day, 7 days a week.
This data is automatically transmitted in encrypted mode (PCI DSS protocol) to be verified to prevent abuse and fraud.
What is 3D Secure?
As part of its fight against fraud, MAISON MINELLI has implemented 3D Secure payment for all its transactions. 3D Secure is an authentication payment system that enhances security during the Customer's online purchases. At the time of payment, the Customer's bank verifies the cardholder's identity before validating the transaction.
This service is offered free of charge to the Customer by their bank for payments by the latter by Carte Bleue, Visa and Mastercard.
The authentication procedure
After validating their bank details, the Customer is transferred to their bank's website. In the 3D Secure window that appears, the authentication process to follow is specific to each bank.
The Client may be asked:
The Customer must check at the time of ordering that they are able to receive the 3D Secure authentication SMS (operator restriction, order from abroad, network coverage, etc.)
Your transaction is canceled after 3 authentication failures. Three canceled transactions result in the Customer's payment card being blocked. In this case, the Customer must contact their bank.
For any questions about the 3D Secure code (obtaining, losing, modifying) and the authentication procedure, the Customer must contact their bank directly.
MAISON MINELLI will never ask the Customer for their bank details by email. To pay online, the Customer simply needs to provide their email address and password.
MAISON MINELLI delivers all orders to mainland France. Upon receipt of their order, the Customer must inspect the exterior of the package and, if necessary, notify the carrier of any reservations. For delivery, MAISON MINELLI offers the Customer one of the delivery methods listed below.

In the event of technical impossibility, the Customer has 3 days, excluding public holidays, following receipt, to notify MAISON MINELLI of their reasoned claim in the event of damage or partial loss. Beyond this time, all action is extinguished.
In accordance with Article L 221-18 of the Consumer Code, the Customer has the right to withdraw from this contract without giving any reason within 14 (fourteen) days, under the conditions set out below.
It is specified that the costs of returning the Products are the responsibility of the Customer and are not refundable. These return costs are fixed at a flat rate of €4.95 and will be deducted from the amount of the refund for the Product(s).
After the period of 14 (fourteen) days, the Products delivered will be deemed accepted by the Customer.
To exercise his right of withdrawal, the Customer must notify MAISON MINELLI of his decision to withdraw from the order by means of an unambiguous declaration.

The Customer may return their package no later than 14 (fourteen) days after having notified MAISON MINELLI of their decision to withdraw from the order. This deadline is deemed to have been met if the Customer returns the Product before the expiry of the 14-day period, to the CHRONOPOST relay point of their choice, to the following address:
DS CONSULTING CORPORATE

93300 AUBERVILLIERS
In this regard, it is up to the Customer to provide proof of this return.
In order to facilitate the processing of the return request, the Customer must attach to their shipment the return slip, received by email following the refund request.
It is again specified that return costs are the responsibility of the Customer and are not refundable. These return costs are fixed at a flat rate of €4.95 and will be deducted from the refund amount of the Product(s).
The Customer has 14 days from receipt of their online order to make an exchange in a MAISON MINELLI store (excluding department stores), or on the website only in the event of a change of size, subject to stock availability.
Please note, however, that MAISON MINELLI stores do not accept exchanges of sale products. The Customer may therefore choose another product whose price is at least identical to the returned product.
In the event of a price discrepancy, the Customer must pay the difference.
The returned Product(s) (including as part of an exchange) must be new, unused and, where applicable, in their original box (shoes or specific accessories).
Any item returned soiled and/or damaged cannot be returned.
Upon receipt of the package, MAISON MINELLI will assess the perfect condition of the returned Product(s). No returns will be accepted if the returned Products have been visibly used or damaged by the Customer, such use or damage rendering the Products unfit for sale.
If the return is refused by MAISON MINELLI, the Products will then be returned to the Customer, where applicable, at the latter's expense without the latter being able to demand any compensation or right to reimbursement, with the exception of the subsequent exercise of its warranty rights on the Products sold.
Likewise, the box containing the returned Product must be returned in an intact condition, accompanied by its tissue paper. In particular, the return label must not be taped to the box to avoid any deterioration.
Any box damaged or showing obvious signs of deterioration will result in the deduction of a fixed amount of 10 euros from the refund of the returned Product or from the price of the exchanged Product (it being understood that this amount will apply for each box damaged or showing obvious signs of deterioration in the event of the return or exchange of several Products), this amount corresponding to the costs of replacing the box and related reprocessing.
Furthermore, all returns must be made in the original box or any other box that belongs to you.
All Products benefit from the legal guarantee of conformity (articles L.217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code), allowing the Customer in particular to return to MAISON MINELLI any Products delivered that are defective or non-compliant.
- Article L.217-4 of the Consumer Code:
“The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.
It is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been made its responsibility by the contract or has been carried out under its responsibility.
- Article L.217-5 of the Consumer Code: “The good is in conformity with the contract: 1° If it is suitable for the use usually expected of a similar good and, where applicable: - if it corresponds to the description given by the seller and has the qualities that the latter has presented to the buyer in the form of a sample or model; - if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling; 2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.” Article L.217-12 of the Consumer Code: “The action resulting from the lack of conformity is prescribed by two years from the delivery of the good. » Article 1641 of the Civil Code: “The seller is bound by the guarantee for hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.” Article 1648 paragraph 1 of the Civil Code: “The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.”
It is recalled that within the framework of the legal guarantee of conformity, the Customer:
Any Product repaired under the legal guarantee of conformity benefits from a six-month extension of said guarantee.
The legal guarantee of conformity applies independently of any commercial guarantee that may cover your property.
It is recalled that the Customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the Civil Code and that in this case, he may choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.
In the event of delivery to the Customer of a Product that does not comply with the order or reveals a hidden defect, the Customer must return the Product to MAISON MINELLI by post.
To this end, the Customer contacts MAISON MINELLI customer service, by email at clients_minelli@maison-minelli.fr , or by telephone at 09 74 35 31 19 (price of a local call) from Monday to Friday from 10:00 a.m. to 5:00 p.m., so that MAISON MINELLI can, if necessary, send them a transport slip (return costs prepaid). Upon receipt of the transport slip, the Customer must send the Product(s) to be dropped off at the DHL collection point of their choice, to the address below:

For full application of the provisions, they will come into effect on the day of their publication at 11:59 p.m. Any orders placed after this date will be governed by the new general terms and conditions.
