General Conditions of Sale and Use of MINELLI gift cards

Preamble

The company MAISON MINELLI issues and offers for sale the MINELLI Gift Card (hereinafter the “Card” or “Gift Card”), which is a prepaid gift card.

These general conditions of sale and use (hereinafter the “General Conditions”) govern all relations between:

  • • On the one hand, the company MAISON MINELLI, a public limited company with a board of directors, with a capital of 100,000 euros, having its registered office at 1 impasse Saint-Eustache, 75001 PARIS, registered with the PARIS Trade and Companies Register under number 983 323 957 (hereinafter “MAISON MINELLI” or “MINELLI”) On the other hand, any adult, non-professional natural person who purchases and/or uses a MINELLI Gift Card (hereinafter the “Customer”).

Art. 1 – Purpose

The General Conditions are communicated to the Customer prior to any sale and will prevail, where applicable, over any other version or any other contradictory document.

They are written in French and may be subject to subsequent modifications, the applicable version being that in force on the date of the transaction.

Art. 2 – Purchase and price

The Card will be offered for sale in MINELLI branch stores located in mainland France (hereinafter the “Store(s)”).

The Card is payable upon ordering without discount. Upon purchase, the Card cannot be discounted at the checkout or given change. Its value is between €30 and €150, at the Customer's discretion.

The purchase of the Gift Card is non-refundable. All purchases are therefore final. The Card cannot be exchanged, resold, replaced, or refunded, even if the balance is unused. Loss, theft, or destruction are not eligible for any refund.

Art. 3 – Acceptance of the General Conditions

Prior to any transaction, the Customer acknowledges having read the General Conditions and declares to accept them. The purchase by the Customer constitutes acceptance without restriction or reservation of these General Conditions.

In the case of the Customer who has not purchased the Card himself, the first use of the Card implies full acceptance of the General Conditions.

Art. 4 – Scope of validity

The Card allows you to purchase products offered for sale in MINELLI Boutiques located in mainland France.

Art. 5 – Loading and activation

The Gift Card is loaded in a single payment with the amount determined by the Customer at the checkout in the Store, in exchange for a cash payment. It is activated during the same checkout. It cannot be reloaded.

MINELLI reserves the right to carry out any checks and to refuse any sale that does not comply with these General Conditions.

Art. 6 – Validity period of the card

The MINELLI Gift Card is valid for one year from the activation date. After this period, the card cannot be renewed. If not used, the credit is lost and no refund will be required.

The expiration date and balance can be viewed in the Store upon presentation of the Gift Card.

Art. 7 – Use of the Gift Card

It can be used once or several times until the balance is exhausted, only in mainland France in MINELLI Boutiques.

The Customer may complete the payment by any other means accepted in-store. The Card is non-nominative, can be given as a gift, but cannot be used to purchase another Card. In the event of loss, theft, destruction, or unused balance, no refund will be issued.

Art. 8 – Return

An unused or expired Card cannot be returned, exchanged or refunded.

Art. 9 – Legal guarantee of conformity and guarantee of hidden defects

The Card benefits from the legal guarantee of conformity (articles L.217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code), allowing the Customer in particular to return the defective or non-compliant Card purchased to the Store.

"The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared. "When the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal guarantee is applicable to this digital content or this digital service throughout the period of supply provided for. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or the digital service and not the date on which it appeared. "The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods. “The legal guarantee of conformity gives the consumer the right to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them. “If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. “If the consumer requests the repair of the goods, but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods. “The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by receiving a full refund upon return of the goods, if: “1° The professional refuses to repair or replace the goods; “2° The repair or replacement of the goods occurs after a period of thirty days; “3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-compliant goods, or if he bears the costs of installing the repaired or replaced goods; "4° The non-conformity of the good persists despite the seller's unsuccessful attempt to bring it into conformity. "The consumer is also entitled to a reduction in the price of the good or to the termination of the contract when the lack of conformity is so serious that it justifies immediate price reduction or termination of the contract. The consumer is then not required to request the repair or replacement of the good beforehand. "The consumer is not entitled to the termination of the sale if the lack of conformity is minor. "Any period of immobilization of the good for the purpose of repair or replacement suspends the warranty which remained to run until delivery of the repaired good. "The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code. "A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code). "The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund upon return of the goods."

To exercise this right, the Customer must go to the MINELLI Boutique of their choice with their Card.

Art. 10 – Liability

The Customer or beneficiary is solely responsible for the use of the Card.

Art. 11 – Personal data

As the Card is non-personal, no data is collected. For customers linked to an account or loyalty program, see the privacy policy .

Art. 12 – Dispute and applicable law

These general terms and conditions of sale are subject to French law. Any dispute that may arise between the Parties due to the formation, interpretation, execution and/or termination of these terms and conditions and, more generally, any dispute resulting from these terms and conditions will, in the absence of an amicable settlement, be referred to the competent court in the matter. For any questions or difficulties, the Customer is invited to contact MINELI's consumer service. The Customer is informed that in the event of failure to reach an amicable settlement with MINELLI's consumer service, they may, in accordance with Articles L612-1 et seq. and R612-1 et seq. of the French Consumer Code, submit their dispute with MINELLI free of charge, electronically or by post, to a mediator who will attempt, in complete independence and impartiality, to bring the Parties together with a view to reaching an amicable solution. MINELLI is a member of the Fédération du e-commerce et de la vente à distance (FEVAD - 60 rue la Boétie –75008 Paris) and, as such, benefits from its e-commerce mediation service, the terms and conditions for which are available at the following address: www.mediateurfevad.fr, it being specified that this mediation service is also valid for any in-store purchase.
